Made to Measure Glass UK is owned and wholly operated by Glass Tailors Ltd. The company is a UK company with trading address Argyle House, Joel Street, Northwood Hills, England, HA6 1NW and the company registration number is 10896638. The company VAT number is _________. VAT is charged on all UK purchases at the standard rate of 20%. Customers accept that by dealing with the Company they agree to the Terms and Conditions contained on this website and that any contract formed with the Company will be a contract under the subject to the laws of England whose courts will have exclusive jurisdiction in the determination of any disputes.
The parties agree that these Terms and the Order Form constitute the entire agreement and understanding between the parties. These Terms and the Order Form supersede all understandings, representations and agreements made between the parties. However, neither party seeks to exclude or limit liability for any fraudulent misrepresentations.
Conditional Acceptance of Order
The purchase of an order indicates your acceptance of these terms and conditions. To order goods you must be at least 18 years of age. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions. These terms and conditions may NOT be altered, supplemented, or amended using any other document(s). Any attempt to alter, supplement or amend this document or to enter an order for product(s) or services that are subject to additional or altered terms and conditions will be null and void, unless otherwise agreed to in a written agreement signed by both Customer and the Company.
Full Payment with order is required for the product to be put into production. Once the payment is received in cleared funds proceeding of the order will commence. All glass will be charged at a minimum of 0.25 square meters. There is an extra 30% handling charge for each panel of 2.5-meter long.
We are entitled to adjust the price to take account of any increase in our supplier's prices or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether the order has been confirmed or not. On the order you must provide us with your exact billing address and a contact telephone number. Incorrect information will cause a delay in processing your order. Your order will only be processed once authorisation of your credit card has been properly received.
If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by e-mail. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.
Description of Goods & Tolerances
As all the products that we sell are of a technical nature it is not practical to publish detailed specifications of all the products. We do provide material data sheets throughout the site where applicable. All images, descriptive matter, specifications and advertising on our website are for the sole purpose of giving an approximate description of the goods and are intended as a guide only. We do not accept responsibility for any preparation work based on such specifications. We endeavour to ensure product descriptions are correct but there may be some colour deviance and small deviances in size tolerance while in the production process which are considered acceptable manufacturing and industry standard tolerances. These are outlined below –
- Mirrors can have a deviance/tolerance of + / - 3mm
- All glass products including glass splashbacks can have a deviance/tolerance of + / - 3mm
The Company reserves the right to slightly change the Products to a similar product, if the original Product is unavailable. The Company shall use its reasonable endeavours to inform you of any such substitutions.
The Consumer Contracts Regulations 2014 states “the supply of goods that are made to the consumer’s specifications or are clearly personalised;” and should be excluded from the Regulations. Consumers have the right to a full refund or exchange within 14 days from the sale date only if the product was not from a bespoke nature and is a product held in stock by the company. Due to the bespoke nature of our Services & Products, once the Customer has placed the order it may not be cancelled if the product is custom made to your needs. In the event of cancellation, the Company will retain the Customer’s deposit.
Installation by the Customer
The Company shall not be responsible for any issues relating to the size or fit of the Product if (a) the Products are ordered without the benefit of a Site Survey by the Company’s qualified installers or (b) the Products are installed by unqualified installers.
Colour is to be chosen from the Company’s standard range, from the Dulux™, RAL, British Standard paint mixing range; a colour match is available at an extra cost. Due to the variation in the manufacture of glass the colours as shown on the colour chart or sample cannot be guaranteed.
The Company will use its reasonable endeavours to match as closely as possible the finished Product with the colour chart, however the Customer is advised that it is difficult to match a printed colour chart with the Company’s paint.
Certain glass types other than Opti-clear have a higher content of iron in them, which causes a green effect that changes the final colour of the colour coat. Please refer to the coloured glass samples for a more accurate indication. The colours on samples are slightly lighter than the finished product as samples allow more light through the edge of the glass thus making the colour lighter.
Title & Risk
Notwithstanding the earlier passing of risk, title in the Product shall remain with the Company and shall not pass to the Customer until all amounts due by the Customer (including any applicable interest and costs) have been paid in full. Until title passes, the Customer shall hold the goods as bail for the Company. The Company may at any time before title passes and without any liability to the Customer repossess and dismantle and use or sell all or any of the Product and by doing so terminate the Customers right to use, sell or otherwise deal in them, and, for that purpose (or determining what if any Product are held by the Customer on inspecting them) enter any premises of or occupied by the Customer. Unless otherwise set out in these Terms, risk passes onto the Customer once the goods are installed, delivered or collected (as the case may be).
Defects, Non-Delivery or Damaged Goods
You must notify us in writing of any damage within 24 hours of the delivery. If we are not notified of damage within 24 hours we cannot accept your claim. You agree to indemnify us in full for any losses we suffer because of your failure to notify us within 24 hours.
If an item on a delivery is damaged, make a note of the damaged item on the delivery paperwork and contact us with the details. Do not refuse the delivery unless every item is damaged. If you refuse a delivery with any undamaged items on it, you will be charged for the return and the redelivery of those items.
Limitation of Liability
Under no circumstances shall the Company have any liability of any kind for: (a) any defects resulting from wear and tear, accident, improper use by Customer or use by the Customer except in accordance with the instructions or advice of the Company; (b) any Product that have been adjusted modified or repaired except by the Company; (c) the suitability of the Product for any particular purpose or use under specific conditions whether or not the purpose or conditions were known or communicated to the Company; (d) any substitution by the Customer of any materials or components not forming part of any specification of the Product unless agreed in writing by the Company; (e) any descriptions, illustrations, specifications, figures as to performance, drawings and particulars of weights and dimensions are contained in the Company’s catalogues, price lists or elsewhere since they are merely intended to represent a general idea of the Products and are not to form part of these Terms or be treated as representations; (f) any technical information, recommendations, statements or advice furnished by Company its servants or agents not given in writing in response to a specific written request from the Customer prior to the acceptance of the Order; or (g) any variations in the quantities or dimensions of any Product or changes of their specifications or substitution of any materials or components, if the variation or substitution does not materially affect the characteristics of the subject matter, and the substituted materials or components are of a quality equal or superior to those originally specified.
The Company shall have no liability to the Customer for any loss or damage of any nature arising from any breach of any express or implied warranty or condition of these Terms or any negligence, breach of statutory or other duty on the part of the Company or in any other way out of or in connection with the performance or purported performance of or failure to perform under these Terms except: (a) for death or personal injury resulting from the Company’s negligence; or (b) as expressly stated in these conditions.
In no circumstances shall the liability of the Company to the Customer under these Terms exceed the invoice value of the Product.
